2008 DUNKMAN OF THE YEAR CONTEST OFFICIAL RULES1.NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. 2. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. 3. REGISTRATION PERIOD; REGIONALS. The 2008 Dunkman of the Year Contest (the “Contest”) will consist of five (5) Regional Competitions (each a “Regional” or collectively, the “Regionals”). Registration for the Contest and each Regional begins January 18, 2008 and ends for each Regional as set forth below (the “Registration Period”). The Regionals will be held on the following dates and times in the following cities: Registration Regional Regional Regional 5. HOW TO ENTER. To enter the Contest, visit www.slamonline.com during the Registration Period, and complete the on-line Registration Form. Contest Registrations for each Regional must be received by 11:59:59 p.m. EST on the Registration Close Date for each Regional listed in section 2 above. Limit one Contest Registration per person. Contestants may participate in only one Regional. In completing the Registration Form, Contestants must represent that they have a vertical jump of at least 35 inches, and must designate their Regional of choice. Entries become the property of Sponsor and will not be acknowledged or returned. For purposes of these Official Rules, “receipt” of a Registration Form occurs when Sponsor’s servers record the entry information resulting from entrant clicking the “Submit Entry” button. (Note that Sponsor will not send entrant a confirmation of receipt of Registration Form.) Any automated computer receipt (such as one confirming delivery of email) does not constitute proof of actual receipt by Sponsor for purposes of these Official Rules. Any illegible, unintelligible, incomplete, or garbled entries are not permitted and will be disqualified. The submission of a Registration Form is solely the responsibility of the entrant, and all internet access and usage charges are the responsibility of the entrant. Any entries not in conformance with these Official Rules will be disqualified. Neither ACI, MOM, Shaquille O’Neal, Goalsetter Systems, Inc., Slam Magazine, PRISM Worldwide, Leader, nor any of their respective parents, subsidiaries, affiliated companies, employees, representatives or agencies, is responsible for: (i) lost, late, damaged, delayed, destroyed, misdirected, incomplete, or illegible entries; (ii) any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alternation of, entries; or (iii) any problems or technical malfunctions of any telephone or communications network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials related to this Contest. 5. GENERAL DESCRIPTION OF CONTEST; RULES, RELEASES. By entering, Contestants agree to be bound by these Official Rules and the decisions of the judges, which are final and binding in all respects. Prior to participating in this Contest, each Contestant will be required to execute an Affidavit of Eligibility and Release. Contestants that refuse to execute an Affidavit of Eligibility and Release will not be permitted to participate in the Contest. By entering this Contest, Contestant releases ACI, MOM, Shaquille O’Neal, Goalsetter Systems, Inc., Slam Magazine, PRISM Worldwide, Leader, and their respective parents, subsidiaries, affiliates, and the directors, officers, employees, or agencies of any of the above organizations from any and all liability for any injuries, losses, tax liabilities or damages of any kind arising from Contestant’s participation in this Contest or resulting from acceptance, possession, use or misuse of any prize. By entering the Contest, Contestant agrees to the use by Sponsor or its designees of Contestant’s name, photographs/likenesses and prize information for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised without compensation except where prohibited by law. Upon request, Contestant agrees to consent to such in writing. (Tennessee residents need not consent to, or sign any, publicity release.) Standing Vertical Jumps; Standing VJ Scores. As part of the overall competition, Contestants will visit a Standing Vertical Jump testing station (the “VJ Station”) where each Contestant’s “Standing Vertical Jump” will be measured by the judges with the aid and use of a vertical jump measuring device. Judges will first determine a Contestant’s standing reach (“Reach”), as measured in inches from the top of a Contestant’s outstretched fingertips to the floor while the Contestant is standing flat-footed and reaching directly overhead. The Standing Vertical Jump for a Contestant will be that amount stated in inches determined by subtracting a Contestant’s Reach from the Contestant’s measured flat footed standing leap (as measured by jumping straight up and touching the vertical jump measuring device). At the VJ Station, each Contestant’s Reach will be measured and each Contestant will have two jumps using the vertical jump measuring device. Each Contestant’s highest jump will be used to determine his Standing Vertical Jump, which will be measured in points (the “Standing VJ Score”), where each inch is worth one point, and increments of inches are worth fractions of a point. Successful Dunks. As part of this Contest, Contestants will also be attempting to dunk a NBA regulation basketball into a Standard-sized basketball rim. (Note that the height of the actual basketball goal will be a minimum of 10 feet, and will vary, depending on the competition described below.) For a dunk to be deemed successful, the Contestant must force the ball completely through the goal and net (a “Successful Dunk”). Dunking Vertical Jump; Dunking VJ Scores. Contestants that advance to the Regional Finals and National Finals (as described below) will also have their “Dunking Vertical Jump” determined in a Dunking Vertical Jump competition (the “Dunking VJ Competition”). The Dunking Vertical Jump for a Contestant will be that amount stated in inches determined by subtracting a Contestant’s Reach from the highest basketball goal height at which the Contestant can execute a Successful Dunk. Dunking Vertical Jumps will be measured in points (the “Dunking VJ Score”), where each inch is worth one point, and increments of inches are worth fractions of a point. Dunking Competition; Dunking Scores. As part of the overall competition, Contestants will have their dunking ability judged by the Contest judges through a dunking competition (the “Dunking Competition”). In the Dunking Competition, Contestants will attempt a dunk on a goal 10 feet in height and be awarded a score as measured in points from a panel of three judges, based on, among other things, whether the dunk is a Successful Dunk, the style and creativity of the Contestant, and the height reached by the Contestant on the dunk (the “Dunking Score”). Each of the three judges at the Dunking Competition will have a maximum of 20 points to award per Contestant (so the maximum total Dunking Score for a Contestant in any competition or round would be 60 points). Determinations as to the measurement of Reach, Standing Vertical Jump and Dunking Vertical Jump, the award of Standing VJ Scores, Dunking VJ Scores, and Dunking Scores and decisions as to whether a dunk is a Successful Dunk are in the sole and absolute discretion of the judges, and such decisions and determinations are not subject to further review or appeal by the Contestants. 6. THE REGIONAL COMPETITION. Contestants should report to their Regional of choice on the appropriate day and time indicated in section 3 of these Official Rules. Specific locations for each Regional are available at www.slamonline.com. Qualifying Round Competition. Contestants at each Regional will have the opportunity to participate in a qualifying round of competition (the “Qualifying Round”), where each Contestant will visit the VJ Station and take part in the Dunking Competition. Full Qualifying Round rules will be provided to each Contestant prior to the Qualifying Round. At the VJ Station, each Contestant’s Reach and Standing VJ Score will be determined as provided above. In the Dunking Competition, each Contestant will have a dunk attempt. If the Contestant’s first dunk attempt results in a Successful Dunk, his first attempt will be judged by the judges and the Contestant will have no further attempts in the Dunking Competition. If the first attempt does not result in a Successful Dunk, the Contestant will have a second dunk attempt which will be judged by the judges, regardless of whether the second dunk attempt results in a Successful Dunk. Each Qualifying Round Contestant will have their Standing VJ Score and Dunking Score added together to produce a total score. The ten (10) Contestants with the highest total scores will be deemed “Regional Finalists” and will participate in the Regional final round competition (the “Regional Finals”), to be held immediately after the Qualifying Round competition. In the event that a tie among Contestants prevents the filling of any of the Regional Finalist positions, a play-off between such tied Contestants will be held in order to fill the remaining Regional Finalist positions. A play-off will consist of a one round Dunking Competition (or more rounds, if necessary) where each tied Contestant’s Dunking Score is determined from one dunk attempt. The tied Contestant(s) with the highest play-off Dunking Score(s) will be deemed the remaining Regional Finalist(s). Regional Finalist Prize. Each of the 10 Regional Finalists in each Regional will receive a cash prize in the amount of $250. (ARV of Regional Finalist Prize is $250.) Regional Finals Competition. The 10 Regional Finalists will each participate in the Regional Finals, and full Regional Final rules will be provided to each Regional Finalist prior to beginning the Regional Finals. The Regional Finals competition will be divided into two competition segments: the Dunking VJ Competition and the Dunking Competition. Regional Finals Dunking VJ Competition Each Regional Finalist’s Dunking VJ Score will be determined in the Dunking VJ Competition through a series of rounds where each Regional Finalist will have two attempts at making a Successful Dunk into a basketball goal. In the first round of the Dunking VJ Competition, the goal will be set at a height of 10 feet, and the goal height will increase by one inch in each subsequent round. If a Regional Finalist does not execute a Successful Dunk after two attempts in a given round, he will be deemed to have completed the Dunking VJ Competition. Each Regional Finalist’s Dunking VJ Score will be determined on the basis of the highest goal height at which he executes a Successful Dunk. Regional Finals Dunking Competition. In the Regional Finals Dunking Competition, each Contestant will have a dunk attempt. If the Regional Finalist’s first dunk attempt results in a Successful Dunk, his first attempt will be judged by the judges and the Regional Finalist will have no further attempts in the Dunking Competition. If the first attempt does not result in a Successful Dunk, the Regional Finalist will have a second dunk attempt which will be judged by the judges, regardless of whether the second dunk attempt results in a Successful Dunk. Each Regional Finalist will have their Dunking VJ Score and Dunking Score added together to produce a total score. The Regional Finalist with the highest total score will be deemed a “Regional Champion” and will advance to the National Finals competition in Phoenix, AZ (the “National Finals”). In the event that there is a tie among Regional Finalists for the highest total score, a play-off between such tied Regional Finalists will be held consisting of a one round Dunking Competition (or more rounds, if necessary) where each tied Regional Finalist’s Score is determined from one dunk attempt. The tied Regional Finalist with the highest play-off Dunking Score will be deemed the Regional Champion. 7. REGIONAL CHAMPION PRIZES. Each Regional Champion from each Regional will receive a trip for 3 days/2 nights to Phoenix, AZ to attend the National Finals competition on June 5th, 2008, (date subject to change) and the opportunity to participate in the National Finals competition held among the five Regional Champions. Regional Champion Prize trip to compete in the National Finals includes coach airfare on an airline selected by the Sponsor from the major airport closest to the Regional Champion’s residence to Phoenix, AZ (airport determined by Sponsor, or its agent, in its sole discretion), two (2) nights Standard hotel accommodations at hotel of Sponsor’s choice, and $75 in spending money. Total Approximate Retail Value of the Regional Champion Prize is $925 (actual value will vary depending on departure and arrival cities, hotel costs, and other factors). In the event that the National Finals competition is postponed or canceled for any reason, Sponsor will not be responsible for awarding that portion of the Prize and no substitution or compensation will be provided. The remainder of the Regional Champion Prize package will be awarded. Regional Champion Prize winner must be able to travel between June 4th, 2008 through June 6th, 2008, or the Regional Champion Prize will be forfeited in its entirety. (Finals date subject to change) If Regional Champion Prize winner cannot travel to the National Finals for any reason whatsoever after all travel arrangements are made, winner will forfeit prize and Sponsor may, at its sole discretion, award the prize to the runner-up in the corresponding Regional Finals competition. Regional Champion Prizes are non-transferable. 8. NATIONAL FINALS. The five Regional Champions will compete against one another in the National Finals competition in Phoeniz, AZ on June5th, 2008 (date subject to change). Full National Finals rules will be provided to each Regional Champion prior to beginning the National Finals competition. The National Finals competition will proceed in the same manner as the Regional Finals, and will be divided into two competition segments: the Dunking VJ Competition and the Dunking Competition. National Finals Dunking VJ Competition Each Regional Champion’s Dunking VJ Score will be determined in the Dunking VJ Competition through a series of rounds where each Regional Champion will have two attempts at making a Successful Dunk into a basketball goal. The tied Regional Champion with the highest play-off Dunking Score will be deemed the “Dunkman of the Year.” 9. DUNKMAN OF THE YEAR PRIZES. The Dunkman of the Year will receive the Dunkman of the Year Prize, consisting of the following: (i) a $10,000 cash prize; (ii) a Dunkman ad in Slam Magazine featuring the Dunkman of the Year; (iii) the Dunkman of the Year trophy; (iv) a Dunkman jersey autographed by Shaquille O’Neal; and (v) a year’s subscription to Slam Magazine. Total Approximate Retail Value of Dunkman of the Year Prize is $11,263. 10. GENERAL. Contest Sponsor: ACI International, Inc., 844 Moraga Drive, Los Angeles, CA 90049. Contest is subject to all applicable federal, state, and local laws and regulations. Unless otherwise specifically provided for herein, all taxes or expenses, including, without limitation, travel expenses, meals, gratuities, transportation costs, sales tax, income tax, luxury tax and any other costs incurred in claiming or using any of the Contest prizes, are the sole responsibility of the prize winner. No prize substitution or cash equivalent of prize, except at Sponsor’s sole discretion, and then only for a prize of equal or greater value. Any difference between the actual value of any prize and the approximate retail value set forth in these official rules may not be claimed and will not be awarded. Failure to comply with these official rules may result in disqualification from the Contest. Sponsor reserves the right, in its sole discretion, to: (i) disqualify from this or any Contest it sponsors, now or in the future, any person it finds, in its sole discretion, has intentionally violated these official rules, tampered with the entry process, the operation of the Contest, or any other aspect of this Contest; and (ii) cancel, modify or suspend part or all of this Contest in the event that errors, tampering, fraud, unauthorized intervention or other causes beyond Sponsor’s control, corrupt or impair the administration, security, fairness or proper play of the Contest. In such event, Sponsor may award prize based on Contest information collected up to the time of Contest cancellation or suspension or to otherwise modify the competition in a manner deemed appropriate by the judges. 11. WINNERS LIST. For a list of prize winners, send a self-addressed, stamped, business-size envelope to be received by June 30th, 2008 to: “2008 Dunkman of the Year” c/o Leader Enterprises, 1775 Woodstock Rd., Suite 200, Roswell, GA 30075. Winners list will be available after Dunkman of the Year is determined.
