Cleveland Cavs Investigating Miami Heat for LeBron Tampering

Dan Gilbert doesn’t give up, you gotta give him that. Whether or not that’ll be enough for David Stern to look into this seriously, though, is up for debate: “The Cleveland Cavaliers have poured hundreds of thousands of dollars into a high-powered Midwestern law firm to investigate their suspicions that the Miami Heat broke NBA tampering rules while pursuing LeBron James, and owner Dan Gilbert has privately vowed he won’t relent until he has a thick binder of findings to drop on the desk of the NBA commissioner, league sources told Yahoo! Sports. The NBA won’t launch an investigation into a tampering case without a formal request from a team, but sources say Gilbert’s plan is to give commissioner David Stern a detailed case that includes meetings, phone calls and contingency plans that date as far back as 2008. Gilbert will implore Stern to use his powers as commissioner to get access to phone records and testimony of key people surrounding Heat president Pat Riley, James and others potentially involved. Gilbert will spare no expense to uncover whatever evidence he can to take to the league office, two sources with direct knowledge of the probe said. The law firm staff includes several former prosecutors with backgrounds in investigating and constructing cases, sources said.

    I love Lebron. I love my Cavs. I HATE the way of the “Decision” is done. I understand the bitterness.. But this kind of thing needs to stop. Now. The league won’t go through this anyway. BTW It’s only Dan Gilbert NOT the Cavaliers team. I believe the Coaching staff and the players don’t give an f**k into this.

    The guys got to let it go, but he might have a case though considering that the Heat and Wade/LBJ/Bosh look like they had planned this all along. With the contracts that the Heat signed for all the contacts to expire at the exact right time so that they could have the financial backing to land all three is unheard of.

    Even the Knicks couldn’t pull it off and they planned to sign as many people as they could last Summer for years.

    @ Ed: Don’t forget LeBron publicly announcing that he was switching his number from 23 to 6 last season. Miami retired 23 in honor of Michael Jordan, so LeBron would not be able to wear 23. Clearly, those guys discussed and agreed to play together, but it may be hard to prove in the court of law or the court of Stern.

    This is ridiculous, Dan Gilbert wanted to give Lebron a big contract, Lebron wanted to go somewhere else then Dan Gilbert calls Lebron a quitter. And, honestly if Lebron got Bosh to come to Clevland he probably would have stayed but it didn’t work out that way. Secondly, when it comes down to it; ultimately the deal was a SIGN AND TRADE. The Cavs did a sign and trade Miami and the Cavs got like two first round draft pics. So Dan Gilbert when it comes down to it you signed Lebron away. Your gonna have a tough time proving any tampering buddy.

    It was reported over summer that after the Cavs/Heat game last year Lebron met with Riley. I don’t know if its true but it was reported. Plus the fact of lebron announcing he was changing his jersey number right after that game as well.

    Gilbert needs to get over it. Again, another way the City of Cleveland will embarass itself, this time through their voice of reason Dan Gilbert. Talk about a witch-hunt. Co-sign T-Money. Not only that, the case would largely be based on hearsay.

    @ Allenp: No and that’s the big loophole. It’s against league rules for anyone in the front office or the coaching staff to collude with players from other teams. There’s also a rule against agents colluding, but there’s no rule against players colluding. Even if there’s evidence of Wade and LeBron colluding, the NBA can’t do anything to punish Miami, but if there’s evidence of Riles, Wade, and LeBron colluding, that’s a different matter and Miami can be punished by the NBA.

    If it wasn’t Riley, I’d say that Gilbert is overreacting. The Heat and Riley have a history of tampering and offering illegal contracts. The Heat tampered with Riley himself while he was still under contract with the Knicks and it cost them some cash and at least 1 first round pick. Riley offered Juwan Howard a contract (1995 I think) that violated the salary cap rules and Stern voided the contract (blessing in disguise for the Heat). Since there is a history of some dirty deals and backroom shenanigans involving the Heat and Riley, then doing a quiet investigation isn’t such a terrible idea. However, since Lebron is involved, there is no way for it to be quiet. I bet the Raptors are waiting for the outcome of Gilbert’s investigation before saying “Oh yeah! Us too!”

    @ The Philosopher: The punishment could be similar to what Minnesota received for the Joe Smith signing…the loss of future draft picks and a multi-million dollar fine. Because Cleveland executed a sign and trade deal with LeBron, it’s impossible for Stern to order LeBron to return to Cleveland.
