Jeremy Lin Wants to Trademark the Word ‘Linsanity’


The business of Jeremy Lin is doing just fine, thank you very much. And the Knick point guard has every intention of making “Linsanity” all his own, in the legal sense. Per Bloomberg: “Jeremy Lin wants to own the term ‘Linsanity.’ Lin, who has rejuvenated the New York Knicks over the past two weeks, moved to take control of the catch phrase that’s encapsulated his meteoric rise, filing an application on Feb. 13 with the U.S. Patent and Trademark Office, according to the agency’s website. The filing came six days after Yenchin Chang, a 35-year-old Alhambra, California, resident with no ties to Lin, became the first to apply for a Linsanity trademark, according to the website. A second filing was made on Feb. 9 by Andrew W. Slayton of Los Altos, California, and on Feb. 14 there was another filing by Yoonsoo Stephen Kim of Duluth, Georgia. ‘We’re prepared to enforce his intellectual property rights,” Pamela M. Deese, a partner in the law firm Arent Fox LLP, said in a telephone interview, confirming that she had filed the application on Lin’s behalf. Trademark applications generally take about three months to be examined and published, according to Gary Krugman, a partner at the Washington-based firm of Sughrue Mion. As Lin, 23, is the subject of the phrase Linsanity, he would probably be successful in opposing an application filed earlier than his own, Krugman said. ‘Nobody can register a mark if it falsely suggests a connection with a person or an institution,’ Krugman said. ‘I would guess that Jeremy Lin would be able to oppose on the grounds that Linsanity points uniquely and unmistakably to him.’”

    @Ka: you are extremely correct. This is only ensuring that he doesn’t get used by anybody else (just look at all of those filings from people who has nothing to do with him). I’m all for it and happy that he finally did it.

    If you can prove that you made it up first, does it matter whether you know Lin or not? Sure its a play on his name, but if someone else made it up, why should he be able to just come in and own the rights to it? Anyone know how these things work?

    You have to wake up pretty early in the morning to win in the trademark game. That being said, I have already filed for trademarking rights to the phrase “The Knicks have been e-Lin-inated from the playoff in the first round”

    For what it’s worth, he’s doing it to stop ppl from using it for profit. FootLocker already has shirts. There was a report that his HS coach had long set up a website selling Limsanity gear because he believed in him so much. Turns out the guy was a coach that his HS had hired (and fired already) two years after he had already moved on to Harvard. Stopping the free use of his “moniker” is smart. I just hope he doesn’t sell it to Nike for a Zillion dollars…well actually, I wouldn’t care. Make that money.

    Isn’t a trademark similar to a patent where you have to ‘prove’ that you created it? I understand that ‘Linsanity’ or ‘Lin..whatever’ is about him, or was created because of him, but I don’t see how he or anyone else can essentially take ownership of the word. It reminds me of Donal Trump geting rights to “You’re fired” (he won) or Paris Hilton losing her case for “That’s Hot”. Trump was able to prove this was a result of his show and Paris couldn’t prove she created anything. I remember the “whoop there it is” t-shirts being sold and the “you can’t touch” this shirts, I wonder if the applicable parties got paid for thoughs or if they even tried.

    @Red — WORD, I also like to dislike people for things out of their control.
    Case in point: Today I saw this elderly lady cross the road, aided by this young man. After the safe crossing, the young man proceeded to spit out his gum onto the side of the road! I am now openly and unabashedly rooting for the elderly lady to die a horrible death. Gum on the sidewalk — have we no decency anymore?!?!

    Most of why Lin Wasnt liked was because we were being force fed. Now those who said Lin isn’t as good as everyone says he is also were right. He isn’t that good, he did have an off game but is just a role player.
